“The state repeatedly has fallen short of its constitutional obligations in a number of critical areas: suicide prevention; the treatment of mentally ill inmates in administrative segregation; those inmates’ access to higher levels of care, including mental health crisis beds; and staffing,” she wrote in her 2023 petition.

“Administrative segregation placements for a special vulnerability should be used only as a last resort,” Alvarez said.

ICE says facility staff are required to offer people in administrative segregation the same privileges as those in general housing, including recreation, visitation, access to the law library and phones.

But administrative segregation, regarded as non-punitive and intended for the detainee’s safety, can be indefinite.

“Placement of detainees in segregation requires careful consideration of alternatives, and administrative segregation placements for a special vulnerability should be used only as a last resort,” he said, using the agency’s terminology for solitary confinement.
