In a recent note to investors, analysts at Bankinter BKT 0.05 % said that, if the O2 deal is scrapped, Telefónica may be forced to switch from a cash dividend to a less appealing scrip dividend, to be paid in company shares.

That Court similarly ended up agreeing with the BKT and the UST that the Chantels had deliberately withheld information, or given false information about their assets on their bankruptcy schedules, with the intent to hinder, delay and defraud the BK and UST and also the Chantels’ creditors.

Thus, the Chantels were denied their discharge, and the Bankruptcy Court determined that all of the assets in the Trust were property of the Chantels’ bankruptcy estate and ordered that property turned over to the BKT.

Their arguments were basically a re-hash of what they argued to the Bankruptcy Court, which was that the assets of the California Trust was not their personal assets, and so therefore they were neither required to list the assets on their bankruptcy schedules nor turn over the assets to the BKT.

In 2013, the BKT brought an adversary proceeding against the Chantels, seeking to deny their discharge.
