A Republican-majority, three-judge panel of the North Carolina Court of Appeals on Friday ordered the state Board of Elections to recalculate the vote totals in the state's contentious Supreme Court race.

The panel, comprised of two Republicans and one Democrat, peppered counsel for Griffin, the state Board of Elections and Democratic North Carolina Supreme Court Justice Allison Riggs for around 90 minutes.

In an appeal, Griffin asked the panel to overturn a lower court's ruling that the North Carolina Board of Elections correctly denied his election challenges, order the board to discount the votes and send the case back for a fact-finding hearing.

Gov. Antonio Delgado removed himself from Gov. Kathy Hochul’s 2026 ticket and filed with the state Board of Elections himself, saying about his future in politics that, “All options are on the table, and I will be exploring them,” a statement some have taken to mean he’s eyeing the governor’s office himself.

Griffin is now suing to overturn the State Board of Elections’ rejection of these protests.
