As the nation witnessed in February of this year, the Alabama Supreme Court ruled that frozen embryos are “extrauterine children” sending devastating ripple effects across the state halting IVF treatments.

The court found that they fell within the protection of the state’s 1872 Wrongful Death of a Minor Act — largely because the law didn’t explicitly provide “an exception ... for extrauterine children,” as Justice Jay Mitchell wrote for the court majority.

Alabama justices in February ruled that three couples could pursue wrongful death lawsuits for their “extrauterine children” after their frozen embryos were destroyed in an accident at a storage facility.

Seen now, in the rearview mirror, of course the Alabama Supreme Court’s solicitude for “extrauterine children” would trump its concern for their extrauterine mothers.

In February, many in vitro fertilization clinics in the state of Alabama paused some of their services after the state’s supreme court said that frozen embryos were “extrauterine children.”
