Judge Marlowe Sommer appeared to be particularly interested in a moment during grand jury proceedings when a detective who investigated the shooting, Alexandria Hancock, was testifying and a grand juror asked her a question about whose responsibility it was to check the gun.

“So the bottom line is the responsibility of making sure these guns — these bullets are not live are up to, what, David Halls and — Hannah?,” the grand juror asked, according to citations of the sealed grand jury transcripts.

The grand juror oath in Georgia requires jurors to “keep the deliberations of the Grand Jury secret unless called upon to give evidence thereof in some court of law of this State.”

The presiding judge in the state’s case, Carli Kierny, upheld Chasing Horse’s indictment last month, writing in an order that prosecutors in Clark County presented enough evidence for “a reasonable grand juror to conclude that the sexual assaults occurred.”

That extra step would further insulate prosecutors from any accusations of grand juror misconduct based on the Kohrs interviews, legal experts said.
